Official Rules
No purchase is necessary to enter or win. Making a purchase will not increase your chances of winning. This Promotion is intended for play in Colorado and will be governed by Colorado law. Do not enter if you are not eligible or located outside of Colorado. Void where prohibited.
Eligibility. The Snap2Save Random Weekly Drawing Promotion (this “Promotion”) is sponsored by Green Piranhas, Inc. (“Sponsor”) and is open to current residents of the State of Colorado who are eighteen (18) years of age or older at the time of entry.
The employees, agents, directors, officers, and contractors of the following entities are not eligible to participate in this Promotion (the following entities being the “Promotional Entities”): (a) Sponsor; (b) the advertising, fulfillment, judging, and promotional agencies involved in the development and administration of this Promotion; (c) the parent companies, subsidiaries, related companies, or other affiliated companies of Sponsor; and (d) Save-A-Lot. The immediate family members and household members (whether or not related) of the employees, agents, directors, officers, and contractors of the Promotional Entities are not eligible to participate in this Promotion.
Participation in this Promotion constitutes your full and unconditional agreement with these Official Rules and Sponsor’s decisions hereunder, which are final and binding in all respects.
Promotional Period and Weekly Drawing Periods. The promotional period will begin on Sunday, March 8, 2020, at 12:00:00 a.m. Mountain Time and end on Saturday, May 2, 2020, at 11:59:59 p.m. Mountain Time (the “Promotional Period”). Each 7-day period within the Promotional Period, beginning on Sunday and ending on the following Saturday, will constitute a “Weekly Drawing Period”. For each Weekly Drawing Period, there will be two (2) winners chosen from each of the eligible Save-A-Lot locations, for a total of four (4) winners per Weekly Drawing Period. The Sponsor’s clock is the official clock for this Promotion.
How to Enter. There are two ways to enter the Promotion: (a) by making a Qualified Purchase (defined below) at a participating Save-A-Lot location or (b) by submitting a free alternative form of entry as described below. Entering the Promotion does not mean you have won a prize.
Qualified Purchase. You will receive one entry to the Promotion by making a Qualified Purchase. A “Qualified Purchase” means a purchase of retail products or services at an eligible Save-A-Lot location with a final purchase price of fifty cents ($0.50) or more that satisfied the following restrictions:
Registered User. To make a Qualified Purchase, you must be a registered user of the Snap2Save mobile application (the “App”).
If you are not a registered user, you may register at any time during the Promotional Period by downloading and installing the App (the App is available free of charge from the Apple App Store and from Google Play), selecting “Register” on the App’s welcome screen, and completing the registration process. To register, you will need to: provide your 10-digit cell phone number, which will be utilized as your user ID (“User ID”); provide your zip code; select a contact preference (email or text message); provide your email address if you select email as your contact preference; select a password; agree to the Terms of Service; and complete the registration process by clicking on the link provided to you in either a follow-up registration confirmation email or follow-up registration confirmation text, depending on the contact preference you have chosen, which will be sent to the email address or 10-digit cell phone number you designated shortly after you submit your registration form thru the App.
Additionally, to receive any Prize in this Promotion, you will need to provide your full mailing address.
Provide User ID at Time of Purchase. To make a Qualified Purchase, you must enter your User ID into the customer PIN pad at the time of purchase, or should you need assistance you may provide your User ID to the sales clerk and ask the clerk to enter your User ID into the register at the time of purchase. You assume all responsibility for correctly entering your User ID into the customer PIN pad, or providing your correct User ID to the clerk, at the time of purchase. Sponsor will not be responsible for your failure to correctly enter your User ID into the customer PIN pad in a timely manner, or your failure to provide your correct User ID to the clerk in a timely manner, or for any sales clerk’s failure to accurately or timely enter your User ID into the register.
Eligible Save-A-Lot Locations. A Qualified Purchase may only be made during the Promotional Period at one of the following eligible Save-A-Lot locations:
- Save-A-Lot, 405 South Circle Drive, Colorado Springs CO 80910
- Save-A-Lot, 1110 Bonforte Boulevard, Pueblo CO 81001
Limit One Entry per Weekly Drawing Period. You may enter this Promotion once per Weekly Drawing Period. Only the first Qualifying Purchase made at any participating Save-A-Lot store by each registered user during any Weekly Drawing Period will qualify for that drawing. Subsequent Qualifying Purchases made during the same Individual Drawing Period, regardless of which participating store they were made at, will not be eligible for that or any drawing.
Free Alternative Method of Entry. You will receive one entry in the Promotion by submitting a free alternative method of entry. To submit a free alternative method of entry, pick up an official entry form at any of the eligible Save-A-Lot locations listed above and complete the form with all requested information, including your first and last name, your complete mailing address, your phone number including area code, your date of birth and your email address. Place the completed entry form in an envelope and mail it first class postage pre-paid to Sponsor at Green Piranhas, Inc., Snap2Save Random Weekly Drawing Promotion, P.O. Box 2653, Littleton, CO 80161-2653. Each entry form must be postmarked during the Promotional Period. Each qualifying free alternative method of entry will be entered in the Weekly Drawing Period in which the entry was postmarked. Sponsor may dispose of: (i) all entry forms in an envelope if more than one entry form is included in an envelope; (ii) entries mailed by metered mail; and (iii) copies, facsimiles, or mechanical reproductions of entry forms. Each entry form will include pre-printed information specifying the eligible Save-A-Lot location where the form originated. Entry forms will be located near the checkout stands at the front of the store. If you have trouble finding an entry form, ask a store employee for assistance.
Additional Entry Terms. Each person is limited to one entry per Weekly Drawing Period, regardless of the manner of entry and the location of entry. After your first entry per Weekly Drawing Period, additional entries during that period will be discarded. Each entry will be eligible and valid for only one Weekly Drawing Period and will not be carried forward to any subsequent Weekly Drawing Periods. Your personal information collected during the course of this Promotion will be used by Sponsor consistent with these Official Rules and the privacy policy applicable to the App.
Drawings and Winner Notification. Within fifteen (15) days of the end of each Weekly Drawing Period, Sponsor will select at random two (2) winners from the eligible entries received at each eligible Save-A-Lot location during the applicable Weekly Drawing Period, for a total of four (4) winners per Weekly Drawing Period. Winners will be notified by email, text message, or regular mail within fifteen (15) days of the drawing. Sponsor may require the potential winner to complete, sign, and return to Sponsor a W-9, an affidavit of eligibility, and a liability and publicity release as a condition to awarding the prize. The prize may be forfeited: (a) if the potential winner does not respond to the notification within seven (7) days after the notification was sent; (b) if the potential winner fails to sign a W-9, an affidavit, and/or a release within seven (7) days after the notification was sent (if required); (c) if a potential winner is not in compliance with these Official Rules, or (d) if the notification or the prize is returned as undeliverable. Sponsor is not responsible if a potential winner changes his or her email address, cell phone number, and/or mailing address. In the event that a potential winner is disqualified for any reason, Sponsor reserves the right, but does not have the obligation, to award the prize to an alternate entrant who will also be selected randomly, even if the disqualified potential winner’s name was publically announced.
Weekly Prizes. Four (4) prizes will be awarded for each Weekly Drawing Period. In each Weekly Drawing Period drawing, and from each eligible Save-A-Lot location: the first eligible entry selected will receive a first prize; and the second eligible entry selected will receive a second prize. The prizes are as follows:
First Prize. The first prize is a one hundred dollar ($100.00) Save-A-Lot gift card, with a retail value of one hundred dollars ($100.00). There will be two first prizes awarded for each Weekly Drawing Period (one per eligible Save-A-Lot location).
Second Prize. The second prize is a twenty-five dollar ($25.00) Save-A-Lot gift card, with a retail value of twenty-five dollars ($25.00). There will be two second prizes awarded for each Weekly Drawing Period (one per eligible Save-A-Lot location).
Thirty-two (32) prizes may be awarded during the Promotion. The total retail value of all prizes that may be awarded during the Promotional Period will be two thousand dollars ($2000.00).
Prize Terms. The odds of winning in any Weekly Drawing Period are two (2) out of the eligible entries received at the eligible Save-A-Lot location where you entered. Limit one (1) prize per Weekly Drawing Period per person. Any taxes are the sole responsibility of winner. No cash alternative or substitution is allowed, except Sponsor reserves the right in its sole discretion to substitute a prize for another article of comparable value. Prizes cannot be returned to Sponsor or to Save-A-Lot for store credit, cash, or other merchandise. Sponsor is not responsible for misdirected, unintelligible, incomplete, lost, or late entries, or for technical, hardware, or software failures, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmissions or other errors or problems of any kind associated with submitting an entry.
Disqualification. Persons who tamper with or abuse any aspect of the Promotion or App, who are in violation of these Official Rules, or who act in an unsportsmanlike or disruptive manner (as solely determined by Sponsor) will be disqualified and all associated entries will be void. Sponsor reserves the right at its sole discretion to suspend, modify, or terminate the Promotion for any reason, including, but not limited to, should any portion of the Promotion be, in Sponsor’s sole opinion, compromised by computer viruses, non-authorized human intervention, or other causes which, in Sponsor’s sole opinion, corrupt or impair the administration, security, or fairness of the Promotion. If so terminated, Sponsor may (but has no obligation to) randomly select the winner from among all eligible, non-suspect entries received prior to termination, or take other action the Sponsor deems fair and reasonable. Automated entries are prohibited and any use of automated devices will cause disqualification. Sponsor reserves the right to prosecute any fraudulent activities to the full extent of the law.
Publicity Release. By accepting a prize, you grant Sponsor and its designees and sub-licensees the right to use your name, biographical information, testimonial, photo and/or likeness, voice, and/or prize information or personal exposition (and/or any edited portion thereof) for advertising, publicity, promotional, and other purposes in any and all media, now or hereafter devised, throughout the world in perpetuity, without additional compensation, notification or permission, except where prohibited by law.
Release and Indemnification. By entering the Promotion, you agree for yourself and your heirs, executors, and administrators: (a) to release, defend, indemnify, and hold harmless the Promotional Entities and their respective employees, agents, directors, officers, and contractors (collectively, the “Released Parties”) from any and all costs, injuries, losses, or damages of any kind due in whole or in part, directly or indirectly, to participation in this Promotion or any Promotion related activity, or from your acceptance, receipt, possession, or use or misuse of a prize; (b) that the Released Parties have neither made nor are in any manner responsible or liable for any representation or guarantee, express or implied, in fact or in law, with respect to any prize or the App, including, without limitation, with regards to quality or fitness for a particular purpose; (c) to comply with all Promotional Entities’ policies, terms, and conditions relating to the use of the App and the Promotion Entities’ websites; and (d) to be bound by these Official Rules and to waive any right to claim any ambiguity or error herein or in the Promotion itself.
Failure to comply with these conditions may result in disqualification from the Promotion at Sponsor’s sole discretion. This release, defense, indemnification and hold harmless obligation shall survive the expiration or termination of the Promotion.
LIMITATION OF LIABILITY. THE PROMOTIONAL ENTITIES’ AGGREGATE LIABILITY ARISING IN CONNECTION WITH THIS PROMOTION, WHETHER IN CONTRACT, TORT, NEGLIGENCE, OR OTHERWISE, SHALL NOT EXCEED (A) $5.00 WITH RESPECT TO NON-WINNERS AND (B) THE STATED RETAIL VALUE OF THE PRIZE WITH RESPECT TO WINNERS. THE PROMOTIONAL ENTITIES SHALL NOT BE LIABLE FOR ANY SPECIAL, INDIRECT, CONSEQUENTIAL, OR EXEMPLARY DAMAGES OR FOR ATTORNEYS’ FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM. YOU ARE NOT ENTITLED TO RESCIND THESE OFFICIAL RULES OR SEEK INJUNCTIVE OR OTHER EQUITABLE RELIEF.
CLASS ACTION WAIVER. ANY PROCEEDING (WHETHER BINDING ARBITRATION OR IN A COURT) TO RESOLVE ANY CLAIM, DISPUTE, OR CONTROVERSY ARISING UNDER OR RELATED TO THIS PROMOTION, THE APP, OR THESE OFFICIAL RULES SHALL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS. ENTRANT WILL NOT SEEK TO HAVE ANY DISPUTE HEARD AS A CLASS ACTION, A REPRESENTATIVE ACTION, OR IN ANY PROCEEDING IN WHICH AN ENTRANT ACTS OR PROPOSES TO ACT IN A REPRESENTATIVE CAPACITY. NO ARBITRATION OR PROCEEDING WILL BE JOINED, CONSOLIDATED, OR COMBINED WITH ARBITRATION OR PROCEEDING WITHOUT THE WRITTEN CONSENT OF ENTRANT, SPONSOR, AND ALL OTHER PARTIES TO ANY SUCH ARBITRATION OR PROCEEDING.
Binding Arbitration. Any claim, dispute, or controversy arising under or related to this Promotion or these Official Rules shall be resolved first by means of direct discussions with Sponsor. If not resolved pursuant to such discussions, the claim, dispute, or controversy shall then be resolved by final and binding arbitration administered by Judicial Arbitration and Mediation Services, Inc. (“JAMS”), in accordance with its streamlined arbitration rules and procedures or subsequent versions thereof (the “JAMS Rules”). The JAMS Rules for selection of an arbitrator shall be followed, except that the arbitrator shall be experienced and licensed to practice law in Colorado.
Governing Law. These Official Rules and the Promotion are governed by the applicable laws of the United States. All issues and questions concerning the construction, validity, interpretation, and enforceability of the Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Promotion, shall be governed by and construed in accordance with the laws of the State of Colorado, without giving effect to the conflict of laws rules thereof. Any matters or proceedings which are not subject to binding arbitration as set forth herein shall take place in the state or federal courts located in Denver, Colorado. Any claim, dispute, or controversy arising out of or related to this Promotion or these Official Rules must be submitted to JAMS (or, if permitted, brought in a court) within three months from the last day of the Promotional Period; otherwise, such claim is permanently barred.
General Terms. If any term or condition of these Official Rules is invalid or unenforceable, then the term or condition may be modified or amended by the Sponsor to render it enforceable to the maximum extent permitted; if modification or amendment is not practicable, then the term or condition shall be severed from these Official Rules with no effect upon the remaining provisions. These Official Rules state the entire agreement between the Sponsor and the entrant. These Official Rules do not confer any rights or remedies upon any person other than you and the Promotional Entities. The Promotional Entities will not be considered in default under these Official Rules to the extent that their performance is delayed or prevented by events outside such entities reasonable control. The failure of Sponsor to insist upon the performance of any provision hereof or to exercise any right or privilege granted hereby will not be construed to be a waiver of such provision, right, or privilege. These Official Rules shall be binding on you and your heirs, executors, administrators, and successors and permitted assigns.
Sponsor. The Sponsor is Green Piranhas, Inc., 8120 South Holly Street, Suite 112, Centennial, CO 80122. For a list of winners, send a self-addressed, stamped envelope to Green Piranhas, Inc., P.O. Box 2653, Littleton, CO 80161-2653, within ninety (90) days after the end of the Promotional Period.
Abbreviated Rules. No purchase or payment is necessary to enter or win this Promotion. This Promotion is available for play in the State of Colorado. Void where prohibited. Thirty-two (32) prizes will be available with an approximate retail value of $2000.00. The odds of winning are two out of the total number of eligible entries for each eligible location during the applicable weekly period. The Promotion ends on May 2, 2020.
